This Privacy Policy applies to Personal Data that Pearson may collect or process in providing testing registration and testing services as a service provider to the Texas Education Agency ("TEA" or "Client"). For purposes of this Privacy Policy "Personal Data" is any information that can be used to identify you or that when added with other Personal Data can be linked to you and includes those listed below.

This Privacy Policy discloses how we collect, protect, use and share information gathered on this Service. Your use of this Service is further subject to the terms of use ("Terms of Use") posted on this website or app (this Privacy Policy is part of the Terms of Use).

This Privacy Policy governs your use of any and all of our Sites, our testing services, and in purchasing our products and services in general. We will use your Personal Data only for the purposes set forth herein.

As the subject of the Personal Data collected, you have rights related to the Personal Data that we hold about you.

At any time you have the right to:

  • Request access to the information we hold about you, subject to the approval of the Client.
  • Ask us how to correct any inaccurate or incomplete information we have about you or request us to make the corrections, subject to the approval of the Client.
  • Request us to delete your information from our records, subject to the approval of the Client.

You may request access, correction, or deletion of and correct the Personal Data you have submitted by logging into your account, calling our toll-free number at 1-877-460-2204, or contacting us at es-postmaster@pearson.com.

Upon receiving any request listed above, we may need to verify your request. In this case, we may ask you to provide additional information, including information you have previously disclosed to us, to confirm your identity. If you wish to designate an authorized agent under any law or regulation, please contact us at the toll-free number above and we will coordinate that designation. We will respond to access requests within a reasonable amount of time in accordance with state and national laws and requirements. We recognize that you may have a right to not receive discriminatory treatment by exercising any of the rights listed above.

What personal information do these Services collect?

The Personal Data Pearson collects or receives about you in providing these Services may include:

  • First Name, Last Name,
  • address,
  • email address,
  • phone number and/or fax number,
  • Social Security number or other government-issued identification number,
  • credit/debit card information,
  • language,
  • date of birth,
  • employment information,
  • previous examination history, and
  • Educational information including educational institutions you attended and the educational institution you have specified to receive your test results ("reporting institution").
  • Internet Service Provider (ISP) Information including: IP address, URL's, domain types, browser type used to access the site, and location of the ISP's servers, pages visited by you while on our site, search terms entered by you on the site, your website and email address. This information may be collected for administration purposes, to gather demographic information, and to monitor activity levels on the site. IP addresses are not linked to personally identifiable information; however we reserve the right to link IP addresses and other information supplied by the ISP to personally identifiable information in order to protect the integrity of our system and for security purposes.

In addition to the information detailed above, at the time of your paper- or computer-based test, depending on the specific test and testing center security requirements, Pearson may also collect: your signature, photographic image, and biometric data including your fingerprint, thumbprint, or palm vein pattern scan, either manually or digitally, when you arrive at the testing center. During your test, you also may be audio and/or videotaped. In instances where we have collected a palm vein pattern scan for Illinois residents, this data will be retained no longer than three years.

After you have completed your test, Pearson also collects your test responses, derives your tests scores and generates a report about your test results.

This website and our Services are not directed to children or anyone under the age of thirteen (13). Pearson will not, through this website or through its test registration and administration process, knowingly collect, maintain or use any personally identifiable information about anyone under the age of thirteen (13).

Data Categories. We may collect and/or disclose to third parties the following categories of data in order to manage day to day business needs including, but not limited to, providing you with our services, performing services on behalf of a business, payment processing and financial account management, business planning and forecasting, system improvements, security and fraud prevention, and compliance with legal and regulatory obligations:

How and why does the Service collect my personal information?

Pearson collects personal information provided by you for purposes of registering, taking and reporting the results of the examinations related to these Services for a variety of reasons:

  • To perform test registration and collect payment for test registration fees;
  • To communicate with you about the test registration, test process, and test results on behalf of the Client;
  • To administer, score and prepare test results;
  • To communicate test results reports to you, the Client and your specified reporting institution;
  • To improve products and services.

In addition, Pearson may use the information you provide to contact you with regard to other test-related information or other opportunities for participation in other testing related studies or activities. What is the legal basis for Pearson using my personal information?

Pearson is processing your personal information with your consent and in order to fulfill our contract obligations to the Client. Providing personal information to register and take the examination covered by this Notice is voluntary. By reading and acknowledging this Notice and registering for the Services associated with this Notice, you consent to have your personal information transmitted and processed in accordance with this Notice.

Will Pearson share my personal information with anyone else?

We do not and will not sell your personal information. We may disclose and share your personal information, including:

  • To the Client and your specified Reporting Institution; and/or
  • To the American Association of Family and Consumer Sciences ("AAFCS"); and/or
  • With relevant third parties (such as law enforcement agencies, your employer or educational institution) if we reasonably believe you may be in breach of the law (e.g. in response to a subpoena, court order, or legal process, to the extent permitted and required by law); and/or
  • To maintain test security and integrity, and/or to protect your security and safety and the security and safety of other persons, data, assets and systems, consistent with applicable law; and/or
  • In connection with a sale, joint venture or other transfer of some or all of our company or assets, subject to the commitment of the acquiring entity to comply with this Notice; and/or
  • With our contractors, agents, or service providers who are committed and required to implement appropriate technical and organizational measures to protect your privacy consistent with applicable law and this Notice; and/or

Purpose of Collecting Personal Data. Pearson may use the Personal Data and content you provide while accessing this site to: a) perform registration and collect payment for edTPA; b) communicate with the edTPA Candidate about the assessment registration, assessment process, and assessment results; c) perform services, including scoring and data analysis; d) prepare and communicate test results to the State Agency, the Candidate, and the Candidate's educator preparation program(s) or entity; e) improve products and services; f) notify you about updates, products, and services related to edTPA; g) contact you regarding opportunities for participation in test-related studies or activities.

Personal Data Collection and Disclosure. The personal data that Pearson collects or receives from Candidates who participate in edTPA may include the following: name, e-mail address, address, phone number, date of birth, gender (optional), credit card or payment information, licensure state, highest education level attained, educational program/institution affiliation, certification level and area, general information about the demographics of the placement reflected in the edTPA submission, English language proficiency (optional), ethnicity (optional), and reason for taking assessment. Upon request, we will (i) deactivate your account, thereby canceling your ability to use the Site, or (ii) correct your Personal Data that you state is erroneous.

Content Collection and Disclosure. Candidate users of this site may submit personal portfolio materials or artifacts through this site for purposes of edTPA scoring at Pearson. All portfolio materials submitted by Candidate users may be viewed by the following individuals: employees, contractors, or subcontractors of Pearson scoring the assessment or providing technical support or related systems or services; authorized Stanford University personnel performing assessment development work, including the selection of scorer training materials and scorer training activities. Submitted assessment materials, or a portion thereof, may be reviewed by authorized individuals at the educator preparation program in which the Candidate is enrolled and/or the relevant state agency responsible for educator certification as part of an investigation associated with compliance with the Rules of Assessment Participation, as needed. Pearson will provide the scores assigned to Candidate portfolio materials or artifacts to the educational program/institution/entity (if applicable) and to participating State Education Agencies, depending on state requirements or policy. edTPA results are anonymously provided to SCALE with candidate responses to registration background questions which address edTPA placement context and demographics of edTPA candidates for the purpose of edTPA assessment analyses and assessment development. edTPA results received by SCALE will not include candidate name or other personally identifying information such as date of birth or partial social security number. With Candidate consent (obtained from response to the associated registration question), edTPA assessment materials, without student or other identifying information, may be used for development activities conducted by Stanford University and/or Pearson to support continued assessment development processes. These development activities may include, but are not limited to, conducting ongoing validity and reliability studies of edTPA. In the event content submitted by users violates state or federal law, or indicates the existence of a threat of harm to any person as determined in Pearson's sole discretion, Pearson may also provide the user's Personal Data and portfolio materials to local, state or federal law enforcement officials.
